As mentioned above, if your license got suspended, and you need to reinstate it, the DMV has likely requested that you obtain something called an “SR-22.” This is not a type of insurance, but rather, an attachment that must be attached to an active insurance policy. In Texas, you are required to carry at least the following amounts of liability insurance:

  • $30,000 per Person for bodily injury
  • $60,000 per accident for bodily injury
  • $25,000 for property damage

The state of Texas requires you to have at least $2500 coverage for personal injury protection, which covers medical expenses and lost wages, regardless of who is at fault.

Texas does not require you to add medical payments or uninsured/underinsured motorist coverage to your liability coverage, but you do have to sign a rejection form excluding them from your policy.

What if I don’t have a car? There are circumstances where an individual wants and needs to reinstate their driver’s license but they do not currently have a vehicle. 

In this circumstance, the individual can purchase a policy that is called a named non-owners policy

As long as the policy meets the minimum liability requirements, an SR22 filing attachment can be added to the policy to help meet the reinstatement guidelines. 

The Named non-owners policy does have coverage restrictions.  Since the insurance policy is written on the individual, and not on a specified vehicle, only liability limits can be selected: no comprehensive or collision coverage.  Coverage is also restricted to covering the named insured only – it is not transferable to any other driver. 

Additionally, this policy will not cover the driver if they are operating a vehicle in which the insured owns, or is owned by a member of the household in which they live.  Though there are restrictions on when the policy is active, an SR22 filing option is available for those insurance companies who offer these kinds of insurance policies in Texas.

Just because the state of Texas says you need to carry your SR22 for the next three years, it does not mean you have to stay with the same insurance policy for the next three years.

What it does mean is that, if you do switch your insurance policies from one carrier to another two guidelines must be met:

  • First, make sure there is no gap in coverage between policies – when one auto insurance policy ends, the other policy must be active so there is no gap in time. 
  • Second, the new insurance policy must also have the SR22 filing notification in place. 

This will allow the new insurance company to send off notification to Texas to let the DMV know you have an active insurance policy, because the old policy will also send over its notification letting know that the old policy is not longer active.
