SR22 Insurance Texas: What Texas Laws do I need to Know?

Besides that, it is essential that you purchase at the very least, the state Minimum Liability limits.

In Texas, you are required to carry at least the following amounts of liability insurance:

  • $30,000 per Person for bodily injury
  • $60,000 per accident for bodily injury
  • $25,000 for property damage

The state of Texas requires you to have at least $2500 coverage for personal injury protection, which covers medical expenses and lost wages, regardless of who is at fault.

Texas does not require you to add medical payments or uninsured/underinsured motorist coverage to your liability coverage, but you do have to sign a rejection form excluding them from your policy.

Sr22 Insurance Texas

What Is An SR-22 in Texas? As mentioned above, if your license got suspended, and you need to reinstate it, the DMV has likely requested that you obtain something called an “SR-22.” This is not a type of insurance, but rather, an attachment that must be attached to an active insurance policy. It notifies the state of Texas that you an insurance policy that meets the state minimum requirements. An SR22 filing also notifies the state that if the policy becomes inactive for any reason. If Texas receives a notification that the insurance policy is inactive, they can revoke your license…again.

SR22 Insurance Texas and PIP

In Texas, SR-22 insurance refers to a form of financial responsibility certification required for certain drivers who have been deemed high-risk due to factors like driving under the influence (DUI/DWI) convictions, driving without insurance, or other serious traffic violations. PIP (Personal Injury Protection) is a separate type of auto insurance coverage that provides medical expenses and, in some cases, lost wages coverage for you and your passengers after an accident, regardless of fault.

While PIP coverage is not directly related to SR-22 insurance, Texas law does mandate certain minimum liability insurance requirements for drivers, which may include PIP coverage. However, PIP is not typically associated with SR-22 filings.

If you’re required to file an SR-22 in Texas, it’s essential to obtain an insurance policy that meets the state’s minimum liability requirements and includes the SR-22 filing. The SR-22 form itself serves as proof to the Texas Department of Public Safety (DPS) that you have the required liability insurance coverage. PIP coverage is not typically part of the SR-22 filing process.

To obtain SR-22 insurance in Texas, you’ll need to:

  2. Purchase an SR-22 Policy: Obtain an insurance policy that meets the state’s minimum liability requirements and includes the SR-22 filing. Your insurance provider will file the SR-22 form with the Texas DPS on your behalf.

  4. Maintain Continuous Coverage: It’s crucial to maintain continuous coverage with your SR-22 insurance policy for the duration required by the Texas DPS. Any lapse in coverage could result in further penalties, including suspension of your driver’s license.
  5. Follow State Requirements: Comply with any additional requirements or restrictions imposed by the Texas DPS as part of your SR-22 filing, such as maintaining a clean driving record or completing a defensive driving course.

What if I don’t have a car and need an SR22 in Texas?

There are circumstances where an individual wants and needs to reinstate their driver’s license but they do not currently have a vehicle.

In this circumstance, the individual can purchase a policy that is called a named non-owners policy

As long as the policy meets the minimum liability requirements, an SR22 filing attachment can be added to the policy to help meet the reinstatement guidelines.

The Named non-owners policy does have coverage restrictions.  Since the insurance policy is written on the individual, and not on a specified vehicle, only liability limits can be selected: no comprehensive or collision coverage.  Coverage is also restricted to covering the named insured only – it is not transferable to any other driver.

Additionally, this policy will not cover the driver if they are operating a vehicle in which the insured owns, or is owned by a member of the household in which they live.  Though there are restrictions on when the policy is active, an SR22 filing option is available for those insurance companies who offer these kinds of insurance policies in Texas.

Which Insurance Company has the lowest price on SR-22 in Texas?

If you noticed, not every auto insurance company in Texas offers the option of filing an SR-22.

And while shopping, you might notice that another insurance company has better rates than the one you are with.

Therefore, many people wonder:

SR22 Insurance in Texas Can I switch insurance while holding an SR22?

Absolutely!

Just because the state of Texas says you need to carry your SR22 for the next three years, it does not mean you have to stay with the same insurance policy for the next three years.

What it does mean is that, if you do switch your insurance policies from one carrier to another two guidelines must be met:

  • First, make sure there is no gap in coverage between policies – when one auto insurance policy ends, the other policy must be active so there is no gap in time.
  • Second, the new insurance policy must also have the SR22 filing notification in place.

This will allow the new insurance company to send off notification to Texas to let the DMV know you have an active insurance policy, because the old policy will also send over its notification letting know that the old policy is not longer active.

So which companies are the best? It really depends on many rating factors, but we tried to narrow down the best SR22 Insurance Texas companies based on each city.

It is still best practice to contact your agent to verify rates based on your personal information and driving history.

Q2: How can I get SR22 Insurance?

Q3: How long do I need to have SR22 Insurance in Texas?

The duration for SR22 Insurance in Texas varies, but it’s typically required for 2 to 3 years. The specific duration depends on your violation and the court’s decision.

Q4: What is the meaning of SR-22?

An SR22 is simply an attachment to an insurance policy that notifies your state of the current insurance policy status – whether active or inactive. The insurance policy must meet the minimum liability requirements set by the Department of Motor Vehicles.

Q5: Where to send SR22 in Texas?

The notification must be sent to the Department of Motor Vehicles driver’s license division. Your insurance carrier will send an electronic notification to the DMV regarding the current insurance status for the individual with the SR22 filing, however, it is also recommended that you send in a copy of the SR22 filing with your reinstatement paperwork and reinstatement fee. It is perfectly fine for the DMV to receive multiple copies of the SR22 filing.

Q6: How long is SR-22 required in Texas?

The SR22 filing requirement in Texas will vary from person to person depending upon the circumstances in which the license was suspended, but a typical time frame we have seen is usually 3 consecutive years. We have seen filing requirements as short as 6 months, but also as long as 7 years. Because the duration of the requirement will vary, we advise our insureds to talk with the DMV during their reinstatement process to find out their specific time requirement. The Department of Motor Vehicles for the State of Texas is the only place you will find out your up to date information on the current requirement status of your driver’s license.

Q7: What is an SR1P filing?

An SR1P filing is similar to an SR22 filing but the key difference is that it applies to vehicles that have less than 4 wheels: motorcycles, mopeds, etc. Though some states have this particular form, most states, such as Texas use the more common approach of an SR22 filing instead.
